Our Terms and Conditions

Guides and hosts affiliated with Frutas y Verduras Mexico operate their tours independently.  In their agreement with us, they agree to include the following in their services offered on this website :

– Full itinerary for the event/ service 

– All food and beverages specified in the description are included in the cost. 

–In some cases, where transportation is required, it may be at an additional cost in consideration for those who do not have to travel. Please read description carefully, noting whether there is additional cost for transportation. A reservation will not be refunded due to a guest’s failure to read the description.

The following are not included in our tour service:

– Personal expenses;

– Personal snacks and beverages (choices made outside those specified in description)

– Souvenirs;

– Medical expenses and medicine;

– Gratuities for servers 

– Lodging and restaurant recommendations

 

RESERVATION AND PAYMENT

All tours/ experiences must be booked and paid for before the tour commences otherwise a space cannot be guaranteed. Payment can be made by credit card via the website. For local tours of 4 hours or less,  booking and payment must be completed no less than 24 hours in advance of the start time of the tour

Full day trips and custom trips each have their own requirement. These are arranged often with local families so in order to respect their needs, please read the individual tour’s booking deadline. If in doubt, we request you book these 7 days in advance. We recommend early booking for special tours and classes.  A tour, class or event is not considered confirmed until it has been paid for.

 

CANCELLATION POLICY

In general, all single-day pre-set tours and classes are non-refundable. Should you be unable to attend your tour at the scheduled time, please communicate with your guide/host about the possibility of rescheduling. If you, or your guide, are unable to reschedule, a Gift Certificate* for the full value of the tour price will be issued. You may use this yourself or transfer to another individual/group. 

Tours and classes of 5 hours or more, cancelled by the guest(s) with notice of 48 hour notice or more, the guest may choose to have a Gift Certificate issued for full amount paid or they may receive a partial refund with a cancellation fee of $25 USD per person. The balance will be refunded within 3 business days. For those tours/ classes cancelled with less than 48 hours notice, no refund will be given, but a Gift Certificate will be issued.

Cancellation of Custom tours. Any custom tour cancelled less than 48 hours before the scheduled start time will not be refunded. A Gift Certificate will be issued.

Custom experiences require a 25% deposit, without exception. This deposit is always non-refundable. A Fully paid experience cancelled with 7 days advance notice or more will receive a refund of of 75%.   Please note that those tours that have been custom planned for groups of 4 people and larger may require a larger non-refundable cancellation fee, dependent on the complexity and length of the itinerary. This will be specified with the itinerary.

Cancellations 48 hours or less before a Custom tour begins — NO refund

For groups of 10 people or larger, cancellations made 14 days or less before a tour date will NOT be refunded. Refunds will not be given for reductions in group size. No exceptions.

Guests who do not show up for their tour will not be refunded.

Guests who arrive late will not be refunded or granted credits or itinerary changes.

*Gift certificates will be valid for 1 full year from the date of issue.


Cancellation by Guide/Host or FYVMexico

We grant a full refund  if we or our Independent Operators must for some reason cancel a tour or class. You have the option to accept an alternative tour, or your money will be refunded within three business days. At no time will our company hold funds beyond three business days. This is not meant to supersede our policy or right to change itineraries. We have the right to and will exercise last-minute changes due to circumstances that may arise.

From time to time an Independent Operator (Guide/host) may need to change an itinerary slightly due to unforeseeable circumstances. Because many small businesses which may be on a tour route operate w/ non-regular hours, an itinerary may have to change at the last minute, without notice. Each guide/host knows their way around finding alternatives, so the quality of your tour will not be compromised. 

For cooking classes, any menu given will be subject to ingredient availability. Changes to a menu will always take into account any food restrictions that were listed by the guest upon booking  

No refunds or credits are issued for itinerary changes or menu changes.

 

SCHEDULED CLASSES AND TOURS

The independent hosts/guides each set their own schedules for group tours. Each has full right to change any schedule (timing) and offer alternative itineraries to participants. This can happen due to  the unpredictable nature of traffic, construction, political manifestations, etc., in Mexico. It is expected that each participant agree to follow the itinerary; any inability to do so is the participant’s responsibility. 

If you booked a tour to a site that is unexpectedly closed due to any reason, as can happen without any notice, we reserve the right to re-schedule.

FYVMexico fully entrusts the planning of tours and classes to the guides as each has been selected based on reputation and history of being reliable as well as knowledgeable. Please consult with your guide should any concerns about your tour arise, so that they can address them immediately. 

Independently Operating Hosts and Guides.

We have carefully selected the Independent Professionals represented on the Site. Each of these individuals design and organize their own experiences as found here on FYVMexico.com / FrutasyVerdurasMex.com. Each is free to make changes to their presentation, within the reasonable range of the description. We use a curatorial process to  select and approve each experience, in order to ensure adherence to the Mission Statement as presented on the Site, and overall quality. Each guide is a local in the sense that they have made their home in the region, are part of the community and have dedicated themselves to continually learning about their local gastronomy, culture and community. 

Independent Operators select the third party providers and sites for the tour. Each tour and cooking class presents regional recipes. To ensure each guest has the best possible experience,  we make it a point to assist you in navigating special dietary needs on these tours. If you, or any other individual who you may be booking on the behalf of, have food allergies or intolerance or a severe dislike for certain foods, it is YOUR RESPONSIBILITY to let your guide/ host  know at the time of booking. If for some reason you forget to do so at the time of booking, please notify your Guide/Host a minimum of 48 hours in advance of your tour/class. Your guide/host cannot accommodate special requests without such notice.

Legal Information

A completed, paid booking  to FYVMexico grants & constitutes consent of the Terms and Conditions explained herein. 

The independent hosts/ guides have the right to remove any disruptive or disrespectful customer without notice. A removed customer is not an agreement of a refund or credit. All funds paid to FYVMexico will be forfeited and are not considered refundable. We reserve the right to refuse acceptance of any customer at our sole discretion without notice or cause.

 FYVMexico can not be held responsible for acts beyond its control, ie: acts of Nature, Acts of War, Planned or Unplanned attacks. We are not responsible for damages or losses including loss of income from persons or entities, such as Restaurants, Chefs, Caterers or any provider/ independent contractor.  In the event of any claims, disputes arising from our relationship or caused by the tours; all parties consent to having their grievances heard in the jurisdictions and venues of the courts in Mexico City, D.F., Mexico.

Waiver of Liability

It is the responsibility of each individual participant to read, understand  and agree to the terms and conditions of Frutas y Verduras Mexico (‘FYVMexico’) prior to reserving and attending each tour.

I agree that FYVMexico, their owners, affiliates, officers, directors, successors or employees are solely operating as the agent through which I am booking this tour, class or event. FYVMexico do not own or operate any entity which provides, or is to provide, goods and services for my tour, including food services providers, food and produce suppliers. As a result, FYVMexico, is not liable for any negligent or willful act or failure to act of the independent operators who are the guides and hosts represented herein.

In addition, I acknowledge that I have voluntarily applied to participate in the tour, class or event designated on this application. I do so with the knowledge of the risks and dangers involved, including but not limited to:

  1. Physical exertion for which I am not prepared;

  2. Foods consumed that may cause negative reaction due to allergy/sensitivity

  3. Risks associated with food or impure water;

  4. Consumption of alcoholic beverages;

  5. Civil unrest; terrorism;

  6. Criminal activity;

  7. Forces of nature;

  8. Transportation failures whether by car, boat, by foot, or by any other conveyance;

  9. Accident or illness without access to means of rapid evacuation or availability of medical supplies or services;

  10. The adequacy of medical attention once provided;

  11. Damaged, stolen, lost, or misplaced luggage or property.

  12. Negligence in the conduct or arrangement of this trip in any respect from inception to completion;

I HEREBY AGREE TO BE RESPONSIBLE FOR MY OWN WELFARE AND PROPERTIES AND ACCEPT ANY AND ALL RISKS OF DELAY, UNANTICIPATED EVENTS, INCONVENIENCE, ILLNESS, INJURY, EMOTIONAL TRAUMA OR DEATH.

I acknowledge that participation in tours, classes or events sold  by FYVMexico and conducted by the Independent Operators is based upon my execution of this Liability Waiver. I hereby RELEASE AND DISCHARGE FOREVER FYVMexico FROM AND AGAINST ANY AND ALL LIABILITY ARISING FROM MY PARTICIPATION IN THE TOUR or CLASS. I agree that this release shall be legally binding upon me personally, all members of my family, and all minors traveling with me, my and their heirs, successors, assigns, and legal representatives, it being my attention to fully assume all the risks associated with this trip and release FYVMexico from any and all liabilities to the maximum extent of the law.

 



Privacy Policy
General Data Protection Regulation (GDPR)
The GDPR is Europe’s new privacy regulation. It gives you control over the data that organizations have about you and how they market to you.

We takes this very seriously, and already apply strict policies and practices to protect all of our customers’ personal data, including those promoted by the EU-U.S. Privacy Shield Framework, E.U. Model Clause Principles and the APEC Privacy Principles. Many of those international standards will continue under the GDPR.

We will not rent or sell or share your email with any third party. However, third party analytics software from Google, Facebook and others may be used (We will update this list should others specifically be added). In some cases, we may place a cookie on your side to enable us to better understand who is visiting the site and how its pages are being used in order to improve the users’ experience.

We use cookies to enable you to have a better experience with our content.

We don’t serve ads to our site visitors using any third-party tools. When we run ads on Facebook, we may use audience data to serve you and people like you ads based on your visits to our sites. We will never inundate you with emails. The most frequently we will ever email you will be once a day if we are promoting a special campaign. We will limit that to 4 consecutive days at most, and will only do this twice per year. We will always be conscience about the quality and value of this content and promotions will always give back to humanitarian organizations that we support.

What does GDPR mean for you?
We’re treating everyone who interacts with our site as if they lived in the EU. This means that if you’re reading this, you can:

1. Ask for a copy of the personal data we’ve collected about you. If you have just asked for information, we have only your email address and phone number if you elected to provide it. If have registered for/ attended one of our events, the relevant guide will only collect such information that is required to provide you with that service. Again, we cannot overstate that this information will never be accessed by any other party.

 

All credit card processing is done with Paypal and we never see your private information
